On March 27, 2020, President Donald J. Trump signed the Coronavirus Aid, Relief, and Economic Security Act (“CARES Act”) into law. Despite efforts by different members of the U.S. House of Representatives and U.S. Senate, the CARES Act does not include legislation tariff relief for goods subjection to the Section 301 tariffs related to the Large Civil Aircraft Dispute. Representative Pascrell (D-NJ) and Senator Menendez (D-NJ) lead this important effort. This was due to opposition from the Administration. The senior staff of Representative Pascrell’s office conveyed that they will make another attempt to include tariff relief in a potential round 4 of the COVID-19 stimulus. As a part of this effort, Representative Pascrell is hoping to include the For Accurate Import Relief To Aid Retailers and Importers of Foreign Freights (FAIR TARIFF) Act (H.R. 5911) as part of any further stimulus bills related to COVID-19. As a reminder, this bill, if passed, will refund the Section 301 duties related to the large civil aircraft (Airbus) dispute with the European Union paid on goods exported on or before Oct. 9, but arriving Oct. 18 or later. This legislation provides a limited refund to American importers and ensures that European producers rightfully bear the burden of the WTO approved countermeasures.
